1. Introduction

Welcome to NightLive. These Terms and Conditions govern your use of our platform, including the mobile application and website. By accessing or using NightLive, you agree to comply with and be bound by these terms. If you do not agree with these terms, please do not use our services.

2. Eligibility

To use NightLive, you must be at least 18 years old or have the consent of a parent or guardian if you are under 18. By using our platform, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.

3. Description of Services

NightLive provides users with information on nightlife venues, including popularity rankings and venue details. We also offer links to third-party platforms where users can purchase tickets. We do not sell tickets directly and are not involved in the transaction process.

4. Links to Third-Party Platforms

NightLive provides links to third-party platforms for purchasing tickets to various venues. We are not responsible for the content, policies, or transactions conducted on these third-party platforms. You should review the terms and conditions and privacy policies of any third-party platform before making a purchase.

5. Disclaimer of Liability

NightLive is not responsible for the quality, safety, suitability, or performance of any venue or event. We provide information and links for your convenience, but we do not guarantee that any venue will meet your expectations. We will not be liable for any direct or indirect losses or damages resulting from your attendance at a venue or event, including but not limited to wasted money, time, or personal dissatisfaction.

6. Ticket Reselling​

NightLive offers a platform for students to resell tickets to one another. By using this feature, you agree to the following terms:

Ticket Listing and Sales

  • Sellers can list tickets on the NightLive marketplace and set their own prices.

  • Buyers can either ‘buy now’ or ‘offer’ a new price. Either option adds both parties to a private chat (where a final price can be negotiated if ‘offer’ is chosen’

  • Once a buyer expresses interest, both parties will enter a private chat where a final price can be negotiated.

Payment and Fees

  • Whether ‘buy now’ or ‘offer’ is chosen, the final price is paid for by the buyer, including a service fee of 10%.

  • All fees are paid for by the buyer.

  • Payments are facilitated by Trustap, our third-party payment provider, and held in escrow until the transaction is complete.

Ticket Delivery and Confirmation

  • The seller is responsible for delivering (uploading) the ticket to the buyer.

  • Once the buyer confirms receipt, a complaint period begins at 2:00 AM on the day of the event. If the ticket is purchased on the same day as the event, the complaint period remains open during and after the event until 2:00 AM.

    • e.g. for an event that starts at 9pm on Wednesday 9th April, the complaint period will begin at 2am Wednesday 9th April and end at 2am Thursday 10th April.

  • If no complaint is filed within this period, Trustap will release the funds to the seller.

Dispute Resolution

If a dispute arises, Trustap will mediate the issue. Both parties agree to abide by Trustap’s resolution process:

  • Seller Responsibility

    • If a complaint is made by the buyer, the seller must be able to provide proof of purchase of the ticket.

  • Buyer Responsibility

    • If a complaint is made by the buyer, they must provide evidence that the ticket did not grant them access to the event.

    • Valid forms of evidence include:

      • A video showing the ticket being rejected.

      • A screenshot of a ticket error.

      • An email from the venue confirming non-attendance or ticket rejection.

  • If a seller knowingly sells a fake ticket or an invalid ticket, they will be immediately banned from the platform, and the buyer will receive a refund.

  • Buyer’s Inability to Attend: The buyer’s inability to attend the event for reasons unrelated to the ticket—including but not limited to change of mind, lateness, illness, or other unforeseen circumstances—will not be considered a valid basis for a dispute or an acceptable reason to request a refund

Penalties for Faulty or Invalid Tickets

  • A faulty or invalid ticket is defined as any ticket that does not allow the buyer to enter the event. This includes, but is not limited to:

    • A ticket that is not for the described event.

    • A ticket that has already been used by the seller before the buyer attempts entry.

    • A situation where the seller fails to send a ticket after payment has been made.

  • If a seller sells a faulty or invalid ticket, they will be immediately banned from the platform, and no payment will be released.

  • If a seller provides a real ticket, but it does not work due to an issue with the venue or event organiser, NightLive is not responsible for the issue. In this case:

    • The buyer will receive a refund, and the seller will not be paid.

    • The seller will not be banned, as the issue is outside their control

7. User Obligations

As a user of NightLive, you agree to:

  • Provide accurate and truthful information during registration and while using the platform.

  • Respect all applicable laws and regulations.

  • Refrain from using the platform for any unlawful or unauthorized purposes, including but not limited to, data scraping, spamming, or hacking.

  • Respect other users and refrain from any abusive or harassing behavior.

8. Intellectual Property Rights

All content, features, and functionality on the NightLive platform, including text, graphics, logos, and software, are the property of NightLive or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You agree not to reproduce, distribute, modify, or create derivative works of any content provided through the platform without explicit permission.

9. Changes to the Terms

NightLive reserves the right to modify these Terms and Conditions at any time. We will notify users of significant changes through email or a notice on our platform. Your continued use of the platform following any changes constitutes your acceptance of the new terms.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the UK Any disputes arising from or relating to these terms will be resolved in the courts of the UK.
